This needs to be taken up with the staff and they need to be given hell several times over for this. Back in the early 90s in my days of kindergarten, this would have been treated at most as a "no-no" or some such, the kids would be reprimanded (probably, if it wasn't simply overlooked as kids being kids) and back to business as usual.
Hell, I've gotten suspended for what in the wonderful world of adult life could be labeled assault - got angry and knocked a kid down to the pavement once or twice - but did the staff decide to turn it into the beginning of a criminal record? No, I got a good stern talking to from both them and my parents/guardians and the opportunity to learn from my mistakes. "Getting along with others" wasn't exactly a strong suit of mine at that time...and admittedly, it still isn't now though not to the same childish extent, but that was about two and a half decades ago.

This right here? Tainting a child's future with that crap? Outrageous doesn't even begin to describe it, and I can assure you this 5 year old kid being autistic has less to do with it than people are claiming.
