I have filed federal complaint over an issue involving my right to cycle (my only method of transportation) while maintaining my safety in doing so. As travel to all places normally able to be traveled is necessary for both life and libert, it is a right. I live on SSI and as such cannot afford to maintain a car. Furthermore it is against my religion, G.O.S. (god of sensibility) agnosticism to drive a car as it is unecessary and has a low cost/benefit ratio. The car simply makes no sense cost wise.
Apparently, as it stands the standard of Idaho code 49-717 is not a reasonable or safe standard, as was bluntly admitted during my traffic court trial. It was interpreted to mean I should ride as close to the curb as possible, without regard for safety, which makes no sense as without safety there is no practice. The reads that I must cycle as close to the edge practicable. I tend to cycle 4 feet off curbs to prevent traffic squeezing issues (see South Lancs travel bus video on youtube for one example of why). The Idaho driver's manual itself, on pages 5-7 (top says I don't have to share a lane that is not wide enough to safely do so) and 5-8 (bottom of which says it is recommended that cyclists stay at least 3 feet off the edge of the pavement and that a normal 12 foot wide lane is NOT wide enough to safely share. Obviously, if there is a curb there I should stay farther from it because if traffic squeezes me I have no ditch to bail into), show clearly that I was within the law to cycle 4 feet off the curb. Color of law was used against me, futhermore the law may not be arbitrarily applied, and it was. Both of these issues alone make this an important federal case.
The court case numbers thus far are 1:16-cv-00121-CWD. The 9th circuit case number in San Francisco is 16-35389.
It currently has been dismissed by the Boise court as I initially filed it against Idaho and United States. I altered it in the brief to the San Fran court to be against the actual defendants as I now realize this is an ex parte young and color of law case.
This has been determined to be frivolous, I guess my safety and liberty and needs are unimportant, and I now have to pay $500 to file it in San Fran and my various motions for accomodations have been denied.
Please at least watch the youtube videos (type the names of the videos into youtube) and read the comments section starting on page 129 of the complaint. These videos and comments will show you the dangers I face in cycling close to a curb.
Please give me whatever help you can. A referal to someone willing to help even would be appreciated. As I live on about $870 per month, I cannot afford legal help and badly need it.
